EL HECHO DE PRESENTAR UNA SOLICITUD PARA SU CONCESI\u00d3N QUE COLME LOS REQUISITOS QUE LA NORMATIVA APLICABLE EXIJA Y EN LA QUE SE PRETENDA EL APROVECHAMIENTO DE UN VOLUMEN DE AGUA INFERIOR AL OFICIALMENTE PUBLICADO COMO DISPONIBLE, NO GARANTIZA SU AUTORIZACI\u00d3N.<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">Los art\u00edculos 27, p\u00e1rrafo primero y 28, p\u00e1rrafo d\u00e9cimo primero, de la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos; 20, 21, 21 Bis, 22, 24, 29 Bis 5 y 42 de la Ley de Aguas Nacionales, que rigen el otorgamiento de las concesiones para la explotaci\u00f3n, uso o aprovechamiento de aguas nacionales, vinculan a la Comisi\u00f3n Nacional del Agua a realizar un estudio particularizado del proyecto correspondiente para verificar que, de aprobarse, no afecte el inter\u00e9s social. En consecuencia, el hecho de presentar una solicitud de concesi\u00f3n que colme los requisitos que la normativa aplicable exija y en la que se pretenda el aprovechamiento de un volumen de agua inferior al oficialmente publicado como disponible, s\u00f3lo constituyen presupuestos o elementos m\u00ednimos para que la autoridad resolutora pueda calificar su viabilidad, pero no garantizan su autorizaci\u00f3n.<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">PRIMER TRIBUNAL COLEGIADO EN MATERIA ADMINISTRATIVA DEL PRIMER CIRCUITO.<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">Amparo directo 416\/2018.
